1. Agreement to Terms

These Terms and Conditions ("Terms") form a binding agreement between you and Auralish Inc. ("Auralish," "we," "us," "our"), a company incorporated in Canada, governing your access to and use of the Brief – AI Interview Coaching mobile application (the "App").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old to use Brief. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Description of Services

Brief provides AI-powered interview coaching, including:

  • Generation of practice interview questions by category
  • Voice-based mock interview sessions analyzed using Google Gemini AI
  • Feedback on interview performance
  • Resume upload and analysis features
  • Profile and progress tracking

The App uses third-party services including Supabase (authentication and backend), Google Gemini AI (voice/text processing), RevenueCat (subscription management), Google Analytics, Google Ads, and Apple Ads.

4. Account Registration

To use certain features, you must create an account via Google Sign-In or Sign in with Apple (including Face ID authentication). You are responsible for:

  • Providing accurate information (name, email, age)
  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. User Content

"User Content" includes resumes, voice recordings, profile images, and any other material you upload or submit to the App.

  • You retain ownership of your User Content.
  • You grant Auralish a limited, non-exclusive, worldwide license to process, store, and analyze your User Content solely to provide and improve the App's features (e.g., sending voice recordings to Gemini AI for feedback generation).
  • You represent that you have the right to upload your User Content and that it does not infringe any third party's rights.
  • You are solely responsible for the accuracy and legality of the resumes and information you upload.

6. In-App Purchases and Subscriptions

  • Brief offers in-app purchases and/or subscriptions, processed through the Apple App Store, Google Play Store, and managed via RevenueCat.
  • Prices, billing cycles, and features are displayed at the point of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with the applicable app store's policies.
  • Refunds are subject to the policies of Apple App Store or Google Play, as applicable. Auralish does not directly process payments or issue refunds outside of these platforms' standard processes.
  • We reserve the right to change pricing with reasonable advance notice.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Upload content that is defamatory, obscene, infringing, or that violates the rights of others
  • Attempt to reverse-engineer, decompile, or extract the App's underlying AI models or source code
  • Interfere with or disrupt the App's servers, security, or third-party integrations
  • Use the App to impersonate any person or entity
  • Circumvent any paywall, subscription, or payment mechanism

8. AI-Generated Content Disclaimer

Brief uses artificial intelligence (Google Gemini AI) to generate interview questions and feedback. You acknowledge that:

  • AI-generated feedback is for practice and informational purposes only and does not guarantee interview or job success
  • AI outputs may occasionally be inaccurate, incomplete, or generic
  • Brief is a coaching tool and not a substitute for professional career counseling or human judgment

9. Intellectual Property

All App content, design, branding, software, and underlying technology (excluding User Content) are owned by Auralish Inc. or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.

10. Third-Party Services

The App integrates third-party services (Supabase, Google Gemini AI, RevenueCat, Google Analytics, Google Ads, Apple Ads, Apple Sign-In/Face ID). Your use of these integrations is also subject to the respective third party's terms of service and privacy policies. Auralish is not responsible for the practices or availability of these third-party services.

11. Push Notifications

By enabling push notifications, you consent to receive reminders, updates, and promotional messages from Brief. You may disable notifications at any time via your device settings.

12. Termination

We may suspend or terminate your access to the App at our discretion, including for violation of these Terms, without prior notice, to the extent permitted by law. You may stop using the App and delete your account at any time by contacting hello@auralish.com.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AURALISH DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED FEEDBACK WILL MEET YOUR EXPECTATIONS OR RESULT IN EMPLOYMENT OUTCOMES.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURALISH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Auralish Inc., its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada, except where local consumer protection laws in your jurisdiction (e.g., EU, UK, California) mandate otherwise.

17. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via the App or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
